The Persons with Disabilities (Equal Opportunities, Protection of rights and Full Participation) Act, 1995 brought in a new perspective to the rights of differently abled people. The Act brought forward Governmental, NGO as well as public participation to the developmental needs of the differently abled people to a more cohesive sphere. The office of the State Commissioner for Persons with Disabilities in Assam was established as per chapter XII Sec 60(1) of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995.
Presently, the office has been functioning under section 79 of the Rights of Persons with Disabilities Act, 2016 and is expected to exercise strict monitoring and evaluation and adherence to the programmes for persons with disabilities with the implementation of the RPWD Act, 2016. The office is mandated to coordinate the work of the Government Departments, monitor the utilization of funds disbursed by the State/Central Government and take steps to safeguard the rights and provisions made available to persons with disabilities and play a quasi-judicial role in all cases arising out of non-implementation of Government and non-governmental agencies with the provision of the Act.
